Borrowers have begun to complain about the difficulties in obtaining credit vacations, and a minority of applicants have managed to obtain them. In banks, the refusals are explained by non-compliance with the requirements, existing arrears or existing vacations. Experts consider the conditions of the program too strict, considering it necessary to change them by law.

According to a survey of top 30 banks, the number of customers who applied for this benefit in the first month of the amendments to the Credit Vacation Act (106-FZ) is already tens of thousands.

So, in VTB for March received about 7 thousand. applications. Raiffeisenbank is talking about 3.5 thousand applications, of which about half were satisfied. Post-bank “connected the holidays” more than 3 thousand customers (the number of appeals is not specified). Rosbank says that in March they received 1.2 thousand. applications, of which more than 370 – are satisfied. The PSB approved 45% of the more than 500 appeals received. Sberbank, the largest retailer in the retail lending market, did not disclose data on appeals. According to experts and competitors, the number of applications from the bank could reach tens of thousands.

Thus, based on these banks, only 30-50% of vacation applications are satisfied.

The Central Bank admits that the regulator has already begun to receive complaints from borrowers related to the provision of credit vacations, although “so far their number is insignificant.” The ONF project “For the rights of borrowers” also says that “we are watching the complaints of bank customers due to difficulties with obtaining a vacation.”

Credit vacations cover mortgages, consumer loans, car loans, credit card debts. The duration of the grace period is from one to six months. You can use credit vacation once for each contract.

The law sets limits on loans under which vacations can be granted. Mortgage limits fluctuate depending on the region: in Moscow it is 6 million rubles, in the Moscow region, St. Petersburg, the regions of the Far Eastern Federal District – 4 million rubles, in other regions of the Russian Federation – 3 million rubles. The limit on car loans is 700 thousand. rubles, on consumer loans – 300 thousand rubles, on credit cards – 100 thousand руб. This does not take into account the balance of the loan, which still needs to be repaid, but the initial amount.

The bankers themselves name several main reasons for refusing a vacation.

Thus, Raiffeisenbank explains the vast majority of refusals (95%) by the fact that the loan is not eligible for the program, in particular, the amount exceeds the maximum set by law, or income decreased by less than 30%. Renaissance Credit adds that the bank may refuse if the client is in arrears before March 1. Uralsib says the reason for the refusal may be the existence of a valid mortgage vacation.

The service of the Financial Commissioner (Ombudsman) clarifies that the bank “in case of unmotivated refusal to provide clients with credit vacations may face risks” – primarily property liability to the debtor, including damages. The borrower has the right to sue to declare the relevant refusal illegal and force the bank to change the terms of the contract, they explain.

According to the head of the ONF project “For the rights of borrowers” Eugenia Lazareva, the law on the provision of credit vacations needs to be adjusted. She believes that it would be fair to record the calculation of limits based on the residual amount of debt at the time of applying to the bank for a vacation.

At the same time, Ms. Lazareva warns that it will be difficult to get credit vacations for borrowers who have lost their jobs by writing a statement of their own volition, as they do not have any confirmation that they are really unemployed, except for the labor exchange.

In addition, many citizens may have serious problems confirming a decline in their income, the expert adds: or with payment for services rendered. And the forms of certificates confirming and explaining the lack of these revenues, the government has not yet developed and has not yet given appropriate instructions on the place.
